The Place and Significience of the Law Numbered 115 in the Turkish History of University

The Universities Law of 1946 was an important milestone in Turkish university history in terms of bringing administrative and academic autonomy and legal personality. This law has taken significant place in history as it binds university autonomy to solid principles and structures. However, the 14-year practice of the Law (1946-1960) and the lack of representation of young academics (associate professors and assistants) in the decision-making bodies of the university revealed the consequences of this inadequacy that led to victimization. The National Unity Committee, which came to power after the military coup of 27 May 1960, not only changed the articles of the Law that negatively affected the personal rights and academic careers of young academics in its 14-year practice; but also carried the administrative autonomy and governance reforms to the highest point by abolishing the articles of the Law regarding the government's limited control authority over the university.

115 SAYILI KANUNUN TÜRK ÜNİVERSİTE TARİHİNDEKİ YERİ VE ÖNEMİ

1946 Üniversiteler Kanunu, idari ve bilimsel özerkliği ve tüzel kişiliği getirmesi açısından Türk üniversite tarihinin önemli bir kilometre taşıydı. Bu kanun daha ziyade özerkliği, sağlam esaslara bağlaması ile zihinlerde yer etmiştir. Ancak kanunun 14 yıllık tatbikatı (1946-1960), üniversitenin karar organlarında genç akademisyenlerin (doçent ve asistan) temsilindeki yetersizliği, bu yetersizliğin mağduriyete yol açan sonuçlarını ortaya çıkarmıştı. 27 Mayıs 1960 Askeri Darbesi’nden sonra yönetime gelen Milli Birlik Komitesi, kanunun 14 yıllık tatbikatında genç akademisyenler aleyhine işleyen maddelerini değiştirmekle kalmamış, kanunda hükümetin üniversite üzerindeki sınırlı denetim yetkisine ilişkin maddelerini yürürlükten kaldırarak idari özerkliği en ileri noktaya taşımıştı.
