Legal Mediation and Reconciliation in Trabzon in the 17th Century: Es-Sulhu Seyyidü´l-Ahkâm (Peace is the Best Judgment)
This study realised using 1836, 1837, 1838, 1840, 1842, 1843, 1844, 1845 numbered Trabzon court records. The court records consist of cases between the dates of 1068-1079/1657-1668. Reconciliation agreements which happened after some disagreements, before and between the mentioned times are the main subject of this article. Disagreements which were ended by peace naturally show differences. These are; inheritance, murder, wounding, theft, property transfers, divorce and entrusted goods. This study, will try to evaluate on the importance of mediators in social life. The study will also focus on the relation between paid money by defendant to the claimant in relation with the subject of reconciliation.

17. YÜZYILDA TRABZON´DA HUKUKİ ARABULUCULUK VE UZLAŞMA: Es-sulhu Seyyidü'l-Ahkâm (Sulh En İyi Hükümdür)
Bu çalışma 1836/1837/1838/1840/1842/1843/1844/1845 nolu Trabzon şer`iyye sicillerinden faydalanılarak gerçekleştirilmiştir. Bahsedilen siciller H. 1068-1079/M. 1657-1668 yıllarına ait kayıtları ihtiva etmektedir. Belirtilen tarihler arasında veya daha önceki zamanlarda Trabzon´da vuku bulan çeşitli uyuşmazlıkların sulh yolu ile çözüme kavuşturulması çalışmanın esas konusunu teşkil etmektedir. Sulh yolu ile çözüme kavuşturulan hususlar çeşitlilik arz etmektedir. Bunlar; miras, borç-alacak, cinayet, yaralama, hırsızlık, mülk satışı, boşanma ve emanet eşya ile ilgili ihtilaflardır. Makalede bahsedilen zaman aralığında sosyal hayatta arabuluculuğun ve arabulucuların yeri ve önemi, sulh sonucu tespit edilen maddi karşılıkların sulhun konusu ile olan ilgisi tespit edilmeye çalışılacaktır.
